REFUND, RETURN, AND CANCELLATION POLICY

1. APPLICABILITY

This Refund, Return, and Cancellation Policy (“Policy”) governs all Orders placed with Rivtec LLC (“Company”) for Goods and Services.

This Policy shall apply to all transactions unless otherwise agreed in writing.

2. NATURE OF GOODS (IMPORTANT DISCLOSURE)

The Customer acknowledges and agrees that:

All Goods manufactured by the Company are custom-fabricated based on Customer-provided specifications

Such Goods are not standard retail products

As a result, Goods are generally non-returnable and non-refundable, except as expressly provided herein

3. ORDER CANCELLATION

3.1 Prior to Production

Orders may be canceled without penalty only if:

Production has not commenced; and

No materials have been procured

3.2 After Production Commencement

Once production has begun, Orders are non-cancellable.

The Customer shall be liable for:

Work completed

Materials purchased or allocated

Engineering and setup costs

A reasonable administrative charge

4. NON-RETURNABLE GOODS

The following items are strictly non-returnable:

Custom fabricated components

Made-to-order assemblies

Special-order or non-standard materials

Parts manufactured to Customer drawings or specifications

5. DEFECTS AND NON-CONFORMANCE

5.1 Notification Requirement

The Customer must notify the Company in writing of any alleged defect or non-conformance within:

Seven (7) calendar days from delivery


5.2 Supporting Evidence

All claims must include:

Detailed description of the issue

Photographic or documented evidence

Relevant inspection or measurement data

5.3 Inspection Rights

The Company reserves the right to:

Inspect the Goods

Request return of Goods for evaluation (at Customer’s cost unless defect confirmed)

6. REMEDIES

If the Company determines that Goods are defective or non-conforming, the Company shall, at its sole discretion:

Repair the Goods

Replace the Goods

Issue a partial or full credit

This shall constitute the Customer’s sole and exclusive remedy

7. EXCLUSIONS

The Company shall not be responsible for defects arising from:

Errors in Customer-provided designs or specifications

Improper installation or handling

Misuse, abuse, or modification

Normal wear and tear

Use outside intended application

8. NO REFUNDS FOR SERVICES

All Services, including but not limited to:

Engineering support

Setup and programming

Fabrication processes

are non-refundable once performed.

9. SHIPPING AND DAMAGE CLAIMS

9.1 The Customer is responsible for inspecting shipments upon receipt.

9.2 Any damage occurring during transit must be reported directly to the carrier.

9.3 The Company shall not be responsible for damage after risk transfer in accordance with agreed Incoterms.

10. LIMITATION OF REMEDIES

Under no circumstances shall the Company’s liability exceed:

The value of the affected Goods only

No refunds or compensation shall be provided for:

Indirect damages

Consequential losses

Project delays or downtime

11. RESTOCKING

Restocking is not applicable to custom Goods.

If the Company, at its sole discretion, accepts a return:

A restocking fee may apply

Return shipping shall be borne by the Customer

12. GOVERNING LAW

This Policy shall be governed by the laws of the State of California, USA.

13. MODIFICATIONS

The Company reserves the right to amend this Policy at any time. Updated versions shall be effective upon posting.
